ZigZag Sports - Liability Waiver
Coherence Technologies (Makers of ZigZagKid) Participation Waiver This Waiver contains a release and waiver of liability (limiting, among other things, your right to sue). PLEASE READ THIS WAIVER CAREFULLY BEFORE AGREEING IN CONSIDERATION of my (and/or my child(s)) participation in all of Coherence Technologies (Maker of ZigZagKid) - ZigZag Sports Activities. You agree this waiver applies to all participants and their parents/guardians or any individual that accompanies the participant. 1. I, as staff, coach, parents/guardians or any individual that accompanies the participant, is fully aware aware that there is risk of injury or loss in connection with any activity, including the potential for serious personal injury, death and property damage. I am aware that while protective equipment and personal discipline may reduce this risk, there still exist a risk of serious injury and is considerable. 2. I freely accept and voluntarily agree to assume all risk of personal injury, death and property damage or loss connected with the Activity howsoever arising, including: (a) conditions on or about the lands and premises, the operation or specifications of the equipment, transportation and any other operations associated with the Activity; (b) actions, omissions or negligence (including failure to use reasonably prudent and careful care, and failure to protect the Participants from risks, dangers and hazards inherent in the Activity) of Coherence Technologies (Maker of ZigZagKid) and its directors, officers, coaches, volunteers, employees, agents and other representatives (the “Coherence and/or ZigZag Personnel”), the owners and lessors of the lands/premises used for the Activity, all of their respective affiliates, successors and assigns (collectively, the “Releasees”), and any other participants or spectators; and (c) any breach of any other duty imposed by law, by equity or by agreement of all or any of the Releasees, including any duty imposed by the Occupiers Liability Act (BC); any breach of any agreement, whether written or verbal. 3. I understand and acknowledge that the activities and equipment in connection with the Activity are physically and mentally intense. I warrant that the Participants are sufficiently fit and trained for the Activity, and that I am not aware of any medical, physical, or psychological circumstances that would prevent the Participants’ participation in the Activity. 4. I hereby waive, release and forever discharge the Releasees from and against any and all manner of liabilities, claims, demands, suits, damages (including direct, indirect, special, punitive, incidental and consequential damages), costs, expenses, debts, actions and causes of action of any kind or nature whatsoever (all, “Claims”), including Claims of loss, damage, injury or death howsoever arising (including as described in paragraph 2), that I or the Participants have, may have, or have ever had resulting from or connected in any way with the Participants’ participation in the Activity. 5. I am aware in an event of an injury, Coherence and/or ZigZag personnel will not be administrating any medication. I, as a parents/guardians or any individual that accompanies the participant will be incharge of administrating any medication. 6. I assume full responsibility for damage/destruction to property caused by the Participants and I will pay, and indemnify Coherence and/or ZigZag Personnel for, any such damage/destruction. 7. To ensure Coherence and/or ZigZag personnel provide best support to the participant during any activity, I hereby give consent to the Coherence and/or ZigZag Personnel to disclose medical information pertaining to the Participants’ and/or individual health and well-being, as necessary. 8. I acknowledge that I have been provided the opportunity to seek legal counsel in connection with this Waiver and, if I did not obtain it, I did so voluntarily without undue influence. I ACKNOWLEDGE that I am not relying on any statement (oral, visual or written) of any person with respect to the safety of the Activity, and I FULLY UNDERSTAND THIS WAIVER. Intending to be legally bound, I agree to this Waiver as set out.
ZigZag Sports - Attendance & Cancellation Policies
Attendance Policy We encourage all participants to attend the classes they have signed up during registration. We understand there would be unforeseen situations which may cause the participants to miss a class. Whenever possible do let ZigZag staff know that participant would be missing a class (s). In an event, multiple classes are missed then ZigZag staff would need to talk to the participant's parents to understand their scheduling needs. Our goal of attendance policy is to ensure that all spots are fully utilized and we are able to accommodate as many participants possible within our community Important In an event, a participant needs parental support, our policy requires parent and/or Guardian to be present (in the room) throughout duration of the class. Withdrawal Policy As per your registration option (once or twice a week), your credit card will be charged at the start of the billing cycle. If you would like to withdraw from the classes, please send an email to sachin@zigzagkid.com. Any withdrawals will be effective from the next billing cycle. You will not be refunded for the current billing cycle.
ZigZag Sports - Payment Policies
Payment Policy Currently, ZigZag is offering two methods of payments: (1) Credit Card - if participants parents/guardian chooses this option, their card will be charged on the first day of class. The charge will be based on their class type selection - once or twice a week. You will be provided with a secure customer portal link which will allow you to manage your account - download invoice, update credit card and others. (2) AFU - Participants parents/guardian may choose to use the option of autism funding provided by BC Government. If this option is chosen, a credit card on file is required on the first day of class. Please follow below link for more information: https://www.zigzagkid.com/autismfunding Important Please note, the actual approval by MCFD depends on their decision based on your submission, availability of funds with your child's eligibility and your child's individual case specifics. If MCFD denies the request the balance owing is the responsibility of the participant parents/guardian and the credit card on file will be charged for owed balance. A credit card on file is required at the first day of class. *There is a one time registration fee that will be charged on your credit card when you sign up on our website
